Good Sam Limited Warranty - Terms and Conditions
Notice to Customer
- With the purchase of Your Product(s), You will receive this Limited Warranty (hereinafter referred to as “Limited Warranty”) at no cost to You as a benefit to your Good Sam Elite membership.
- The Coverage under this Limited Warranty has total limit of $500 per Good Sam Elite Membership per membership year. See Coverage and Limit of Liability sections for more information.
- You must have an active Good Sam Elite membership on the Purchase Date and at the time of submitting a claim to receive benefits under this Limited Warranty.
- This Limited Warranty runs concurrent with, and is secondary to, any applicable manufacturer’s warranty.
- Limitations of Implied Warranty – All Implied Warranties which may arise under state law, including all Implied Warranties of Merchantability or Fitness for a particular purpose, are limited to the duration of this Limited Warranty and do not cover incidental or consequential damages. Some states do not allow limitations on how long an Implied Warranty lasts or the exclusion of incidental or consequential damages, so the above limitations or exclusions may not apply to You. This Limited Warranty gives You specific legal rights, and You may also have other rights, which vary from state to state.
Definitions
- The Administrator is United Service Protection Corporation, P.O. Box 21647, St. Petersburg, FL 33742, 1-866-769-8097.
- Deductible - There is no deductible under this Limited Warranty
- Product(s) means the item(s) purchased for personal use, from a Camping World Retailer as listed on the sales receipt or ordering document, that qualify for coverage under this Limited Warranty.
- Purchase Date means the date You purchased the Product(s) as listed on Your original sales receipt or ordering document.
- Retail Cost means the lesser of the pre-tax retail cost or discounted cost (excluding sales tax) of the Product(s) at the time of purchase, covered under this Limited Warranty.
- Retailer means the Camping World Retailer from whom You purchased the Product(s) covered by this Limited Warranty as indicated on Your sales receipt or ordering document.
- Warrantor/We/Us/Our means the entity that is obligated to perform under this Limited Warranty: Camping World, 2 Marriott Dr., Lincolnshire, IL 60069, (844) 480-0345.
- You/Your means the owner of the Product(s) covered under this Limited Warranty and on record with the Administrator.
Limited Warranty Term
This Limited Warranty begins on the Purchase Date listed on Your original sales receipt or ordering document and ends 12 months following the Purchase Date. If the term of this Limited Warranty overlaps with the term of Your manufacturer’s warranty, look first at Your manufacturer’s warranty for coverage. This Limited Warranty excludes coverage for any loss covered by Your manufacturer’s warranty.
Product Eligibility
You must have an active Good Sam Elite membership on date of purchase and at the time of submitting a claim to receive benefits under this Limited Warranty. This Limited Warranty covers Product(s) purchased as new Product(s) manufactured for use in the United States of America. This Limited Warranty will only cover Product(s) used for non-commercial purposes.
Coverage
IF YOUR PRODUCT IS REPLACED, ALL OBLIGATIONS WILL BE SATISFIED, AND NO FURTHER REPAIRS OR REPLACEMENTS WILL BE MADE UNDER THIS LIMITED WARRANTY FOR THE REPLACEMENT PRODUCT.
If, during the Limited Warranty term, Your Product(s) is rendered inoperable as a result of mechanical or electrical breakdown, structural or component failures, defects in materials and workmanship, and are not covered under any other warranty, insurance policy or service contract, We will provide necessary service to restore Your Product(s) to normal operating condition, or provide a replacement product, up to a total limit of $500 per Good Sam Elite Membership per membership year, regardless of the number of covered Products.
Repairs will be performed by the Retailer. If the Product(s) cannot be repaired or is not cost effective to repair, the Retailer will provide a settlement (e.g., gift card or cash refund) equal to the Retail Cost, up to a total limit of $500 per Good Sam Elite Membership per membership year. If a replacement product has a lower retail price due to technological advancements, no refund will be issued for the difference.
Parts used to repair or replace Your Product(s) may be new, used, refurbished or non-original manufacturer’s parts that perform to factory specifications of the Product(s). If repair parts are unavailable because the manufacturer is no longer in business or no longer manufactures the parts necessary to repair Your Product(s), or if the Product(s) were purchased through a catalogue or on-line, You will receive a gift card or cash settlement equal to the value of the replacement product, not to exceed the lesser of the current retail replacement value of the original Product(s) or the original purchase Retail Cost of Your Product(s), excluding sales tax, up to a total limit of $500 per Good Sam Elite Membership per membership year.
This Limited Warranty does not cover repair or replacement of the Product(s) for any of the causes or provide coverage for any losses set forth in the EXCLUSIONS section.
If You Need Service
To Initiate a Service Request – If Your Product(s) was purchased from a Retailer, You must contact the Retailer that issued this Limited Warranty. If you are unable to get to the Retailer that sold you the Product, please contact the Administrator, or visit the nearest Retailer location. If Your Product(s) was purchased on-line visit elite.goodsam.com/claims. For all service requests the Administrator must authorize all repairs or replacements in advance. Unauthorized repairs or replacements may invalidate this Limited Warranty. Service will be provided during normal business hours. We will try to complete service as quickly as possible; however, We are not responsible for delays caused by factors beyond Our control, including, but not limited to: manufacturer’s parts delay, shipping to regional service facilities, or acts of God. You have the duty to protect Your Product(s) against any further damage and comply with the owner’s manual instructions (if owner’s manual is available).
You may be required to return Your defective Product(s), along with all accessories and batteries as a condition for receiving a replacement product or reimbursement. If directed to mail in Your Product(s), You are responsible for packing the Product(s) in the original or comparable packaging to prevent further damage during shipping.
Limit of Liability
THE TOTAL LIABILITY UNDER THIS LIMITED WARRANTY WILL NOT EXCEED THE RETAIL COST FOR THE COVERED PRODUCT UNDER ANY CIRCUMSTANCES, UP TO A MAXIMUM OF $500 ANNUALLY PER GOOD SAM ELITE MEMBERSHIP. IN NO EVENT SHALL THE AGGREGATE LIMIT OF ALL PRODUCT REPAIR OR REPLACEMENT CLAIMS AND ASSOCIATED COSTS EXCEED THE RETAIL COST PAID BY YOU FOR THE COVERED PRODUCT, UP TO A MAXIMUM OF $500 ANNUALLY PER GOOD SAM ELITE MEMBERSHIP. WE SHALL NOT BE LIABLE FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, INCLUDING, BUT NOT LIMITED TO LOSS OF USE, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF TIME RESULTING FROM FAILURE OF ANY PRODUCT OR FROM DELAYS IN SERVICE OR INABILITY TO PROVIDE SERVICE RELATING DIRECTLY OR INDIRECTLY TO THIS LIMITED WARRANTY. WE SHALL NOT BE LIABLE FOR ANY PRE-EXISTING CONDITIONS THAT OCCUR PRIOR TO THE EFFECTIVE DATE OF THIS LIMITED WARRANTY. IF YOUR PRODUCT IS REPLACED, ALL OBLIGATIONS WILL BE SATISFIED, AND NO FURTHER CLAIMS WILL BE PAID UNDER THIS LIMITED WARRANTY FOR THE REPLACEMENT PRODUCT.
Cancellation & Transferability
This Limited Warranty was issued at no cost to You and is non-cancelable and non-transferable.
Consumer’s Promises and Assurances
During the term of this Limited Warranty, You must maintain the Product(s) in accordance with the service requirements set forth by the manufacturer’s specifications, including cleaning and maintenance. You must provide proper electrical requirements as specified by the manufacturer. In addition, You promise and assure: (1) full cooperation with the manufacturer, Administrator, technicians and authorized servicers during diagnosis and repair of the Product(s); and (2) that You will provide written notice of any defect or deficiency in service within ninety (90) days of discovery.
Exclusions
This Limited Warranty does not cover any of the following:
- ANY PRODUCT PURCHASED OUTSIDE OF CAMPINGWORLD.COM, A CAMPING WORLD STORE OR AFFILIATED DEALERSHIP;
- ANY LABOR CHARGES TO REMOVE OR REPLACE, DE-INSTALL OR REINSTALL, ANY ITEM THAT IS COVERED UNDER THIS LIMITED WARRANTY FROM ANY VEHICLE OR CONVEYANCE, WHETHER OR NOT ITEM WAS ORIGINALLY INSTALLED BY AN AUTHORIZED RETAILER OR OTHER PARTY;
- PRODUCT SOLD WITHOUT A MANUFACTURER’S WARRANTY SOLD “AS IS” OR CLEARANCE ITEMS
- PARTS PURCHASED FOR USE WITH OR INSTALLATION ON ANY PRODUCT(S) OWNED BY YOU PRIOR TO THE PURCHASE DATE OF THE PART(S), INCLUDING REPLACEMENT PARTS, ACCESSORY PARTS, OR COMPONENTS INTENDED TO REPAIR, MODIFY, ENHANCE, OR OTHERWISE SUPPORT A PRE-EXISTING PRODUCT(S); SUCH PARTS SHALL NOT BE CONSIDERED COVERED PRODUCT(S) UNDER THIS LIMITED WARRANTY." or "ANY PART, COMPONENT, OR ACCESSORY PURCHASED SEPARATELY FOR A PRODUCT(S) THAT YOU OWNED OR HAD IN YOUR POSSESSION PRIOR TO THE PURCHASE DATE OF SUCH PART, INCLUDING BUT NOT LIMITED TO REPLACEMENT PARTS, UPGRADE PARTS, OR ADD-ON COMPONENTS; THESE ITEMS ARE EXPRESSLY EXCLUDED FROM COVERAGE AND SHALL NOT QUALIFY AS COVERED PRODUCT(S) UNDER THIS LIMITED WARRANTY.
- FACTORY REFURBISHED PRODUCTS;
- REPAIRS CAUSED BY ACTS OF GOD, POWER SURGES (FOR SURGE PROTECTORS, OVER THE RATED COVERAGE), ACCIDENT OR INTENTIONAL DAMAGE, LACK OF MANUFACTURER’S SPECIFIED MAINTENANCE, IMPROPER PRODUCT MODIFICATIONS; MILDEW, RUST, CORROSION, MOISTURE, SPILLED LIQUIDS, LIQUID IMMERSION, INSECT INFESTATION/VERMIN, DEFECTIVE OR WORN OUT BATTERIES, BATTERY LEAKAGE, OPERATOR NEGLIGENCE, MISUSE, ABUSE; EXPOSURE TO WEATHER, EXTERNAL FACTORS AND ENVIROMENTAL CONDITIONS SUCH AS SULPHER, ETC., PRODUCT(S) WITH ALTERED OR MISSING SERIAL NUMBERS;
- UNAUTHORIZED REPAIRS, IMPROPER INSTALLATION OR ATTACHMENTS, TRANSPORTATION DAMAGE AND DAMAGE CAUSED BY UNAUTHORIZED REPAIR PERSONNEL;
- REPLACEMENT COST FOR LOST OR CONSUMER REPLACEABLE PARTS (SUCH AS KNOBS, REMOTES, ALL BATTERIES, BAGS, BELTS, BULBS, ETC.) AS DETERMINED BY US;
- COSMETIC DAMAGE AND PROBLEMS DUE TO IMPROPER INSTALLATION OR REPAIRS;
- CUSTOM INSTALLATIONS IN CABINETRY AND OTHER TYPES OF BUILT-IN APPLICATIONS INACCESSIBLE TO THE SERVICE TECHNICIAN;
- SPECIAL, INDIRECT, CONSEQUENTIAL, OR INCIDENTAL DAMAGES OR DELAY IN RENDERING SERVICE, INCLUDING, BUT NOT LIMITED TO, LOSS OF USE DURING THE PERIOD THAT THE PRODUCT IS AT THE REPAIR CENTER OR AWAITING PARTS, LOSS OF BUSINESS, LOSS OF PROFITS, LOSS OF DATA, DOWN-TIME AND CHARGES FOR TIME AND EFFORT;
- “NO PROBLEM FOUND” DIAGNOSIS, NON-FAILURE PROBLEMS, INCLUDING BUT NOT LIMITED TO ITEMS NOT COVERED, NOISES, SQUEAKS OR INTERMITTENT ISSUES THAT ARE NOT PRODUCT(S) FAILURES;
- ACCESSORIES AND/OR ADD-ON OPTIONS PURCHASED SEPARATELY AND NOT ESSENTIAL TO BASIC PRODUCT(S) FUNCTIONALITY, PRODUCT(S) NOT ASSOCIATED WITH THE PURCHASE OF THIS LIMITED WARRANTY, INCLUDING AFTERMARKET INSTALLATIONS/MODIFICATIONS;
- ANY FEES RELATED TO THIRD PARTY CONTRACTS;
- REPAIR OR REPLACEMENT AS A RESULT OF ANY CAUSE OTHER THAN NORMAL USE AND OPERATION OF THE PRODUCT(S); REPAIR OR REPLACEMENT DUE TO YOUR FAILURE TO FOLLOW THE MANUFACTURER’S SPECIFICATIONS, OWNER’S MANUAL AND THE MANUFACTURER’S INSTRUCTIONS AS DETERMINED BY US;
- CLEANINGS AND ALIGNMENTS;
- THEFT, VANDALISM, LOSS, OR PHYSICAL DAMAGE;
- FAILURE TO USE REASONABLE MEANS TO PROTECT YOUR PRODUCT(S) FROM FURTHER DAMAGE AFTER LOSS;
- UNAUTHORIZED TRANSPORTATION, SHIPPING CHARGES, OR REPAIRS;
- ANY REPAIR THAT IS A RESULT OF IN-WARRANTY PARTS NOT PROVIDED OR SHIPPED BY THE MANUFACTURER;
- DAMAGE OR PRODUCT FAILURE COVERED BY A MANUFACTURER’S WARRANTY, MANUFACTURER’S RECALL, OR FACTORY BULLETINS (REGARDLESS OF WHETHER OR NOT THE MANUFACTURER IS DOING BUSINESS AS AN ONGOING ENTERPRISE);
- LIABILITY OR DAMAGE TO PROPERTY, OR INJURY OR DEATH TO ANY PERSON ARISING FROM THE OPERATION, OR USE OF THE PRODUCT(S);
- COST OF PREVENTATIVE MAINTENANCE OR DAMAGES CAUSED BY IMPROPER PREVENTATIVE MAINTENANCE;
- SEIZED OR DAMAGED PARTS RESULTING FROM FAILURE TO MAINTAIN PROPER QUALITY, TYPE, OR LEVELS OF LUBRICANTS OR COOLANTS; RESULTING FROM THE USE OF CONTAMINATED OR IMPROPER LUBRICANTS; RESULTING FROM STALE, CONTAMINATED, OR IMPROPER FUEL; OR RESULTING FROM FREEZING OR OVERHEATING;
- EXPOSURE TO CHEMICALS, BLEACHES, CAUSTIC SUBSTANCES, OPEN FLAME, HIGH HEAT AND SHARP OBJECTS;
- LACES AND NON-FUNCTIONAL OR AESTHETIC PARTS; INCLUDING BUT NOT LIMITED TO: FIT RELATED PROBLEMS, MISSING BUTTONS, CLASPS, BEADS AND ANY OTHER DECORATIVE EMBELLISHMENTS AND/OR ACCESSORIES ATTACHED TO THE PRODUCT;
- PRODUCT(S) WITH SAFETY FEATURE(S) REMOVED, BYPASSED, DISABLED, OR ALTERED;
- PRODUCT(S) USED FOR COMMERCIAL, NON-PROFIT ORGANIZATION, OR GOVERNMENT PURPOSES (MULTI-USER ORGANIZATIONS), PUBLIC RENTAL, OR COMMUNAL USE IN MULTI-FAMILY HOUSING (USE OF A PRODUCT(S) FOR THESE PURPOSES WILL VOID THIS LIMITED WARRANTY);
- DAMAGE TO AWNING OR PARTS OF AWNING DUE TO FAILURE TO CAREFULLY RETRACT AWNING WHILE DRIVING VEHICLE, DAMAGE TO FRAMING SYSTEM AND/OR COMPONENT PARTS AS A RESULT OF FAULTY INSTALLATION, REINSTALLATION OR SERVICE DAMAGE TO THE STRUCTURE TO WHICH THE AWNING IS INSTALLED OR ATTACHED, OR TO PROPERTY OR ITEMS LOCATED ABOVE, BELOW OR NEAR AWNING;
- DAMAGE TO RV’S, BOAT’S, PERSONAL WATERCRAFT’S COVERS OR PARTS OF COVERS, DUE TO IMPROPER INSTALLATION, SHARP OR PROTRUDING OBJECTS AND FIXTURES OF THE RV, BOAT, PERSONAL WATERCRAFT DUE TO INSUFFICIENT PADDING OR LOWERING, IMPROPER TIGHTENING OF STRAPS, OVER TIGHTENING; FURNITURE FABRICS, ANY FURNITURE, AND ALL NON-STRUCTURAL DAMAGE TO COVERS, INCLUDING BUT NOT LIMITED TO FIRE DAMAGE, CORROSION, MOISTURE, CIGARETTE BURNS, STAINS, PET DAMAGE (BITES OR SCRATCHES), ODORS, SPLIT LEATHER, NON-OPERATING OR DECORATIVE PARTS SUCH AS HINGES, KNOBS, CLOCK MECHANISMS, DAMAGES RESULTING FROM DROPS, FALLS, COLLISION, SPILLS AND ANY OTHER TYPE OF ACCIDENTAL HANDLING; DAMAGE TO A COVERED COMPONENT CAUSED BY A NON-COVERED COMPONENT;
- REPAIRS RECOMMENDED BY A REPAIR FACILITY NOT NECESSITATED BY MECHANICAL OR ELECTRICAL BREAKDOWN.
Entire Limited Warranty
This Limited Warranty represents the entire agreement between You and Us. No person has the authority to change this Limited Warranty or to waive any of its provisions. No other written or oral statements apply to this Limited Warranty.
